1. Acceptance of Terms

By creating an account on DiamondConnect or using our platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use DiamondConnect. You must be at least 18 years of age to create an account or use our services.

2. Description of Service

DiamondConnect is a hiring marketplace that connects baseball and softball facilities with qualified coaches. Our platform provides structured coach profiles, job postings, search and filtering tools, in-app messaging, and subscription-based access for facilities. Coaches can create profiles and apply for jobs at no cost.

3. Account Types and Responsibilities

Coach Accounts

Coach accounts are free to create and use. Coaches are responsible for the accuracy of all information in their profiles, including credentials, experience, certifications, and any video content they upload.

Facility Accounts

Facility accounts require a paid subscription to access full platform features. Facilities are responsible for the accuracy of job postings, organization information, and any content they share on the platform.

Account Security

All users must keep their login credentials secure and must not share account access with others. If you become aware of any unauthorized access to your account, you must notify us immediately at support@diamondconnect.com.

4. Subscription Terms (Facilities)

• Facilities pay a monthly subscription fee for platform access. Three tiers are available: Basic, Pro, and Enterprise, each with different feature limits.
• New facility accounts receive a 7-day free trial to explore the platform.
• Billing is recurring monthly and will be charged to the payment method on file.
• You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.
• No refunds are provided for partial months or unused time remaining in your billing period.
• DiamondConnect LLC reserves the right to change subscription pricing with 30 days advance notice. Continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

When using DiamondConnect, you agree not to:

• Post false, misleading, or fraudulent information
• Harass, discriminate against, or threaten other users
• Use the platform for purposes other than legitimate hiring or job seeking in baseball and softball
• Scrape, crawl, or extract data from the platform using automated tools
• Attempt to circumvent security measures or access other users' accounts
• Post spam, unsolicited offers, or content unrelated to baseball/softball coaching and employment

6. Content and Intellectual Property

• Users retain ownership of content they post, including profiles, videos, and job listings.
• By posting content on DiamondConnect, you grant us a non-exclusive, royalty-free license to display, reproduce, and distribute your content on the platform.
• DiamondConnect reserves the right to remove any content that violates these Terms of Service.
• The DiamondConnect name, logo, and platform design are the property of DiamondConnect LLC and may not be used without written permission.

7. Hiring and Employment Disclaimer

DiamondConnect is a marketplace that connects facilities with coaches. It is important to understand that:

• DiamondConnect is NOT an employer, staffing agency, or employment service.
• We do not guarantee employment outcomes for coaches or successful hires for facilities.
• DiamondConnect does not independently verify credentials or conduct background checks unless purchased as an add-on service.
• All hiring decisions are made solely by the facilities.
• DiamondConnect is not responsible for the conduct, qualifications, or actions of coaches or facilities.

8. Account Suspension and Termination

• DiamondConnect may suspend or terminate accounts that violate these Terms of Service, at our sole discretion.
• Users may delete their account at any time by contacting support@diamondconnect.com.
• Upon termination, access to the platform ceases immediately. Some data may be retained as required by law or for legitimate business purposes.

9. Limitation of Liability

• DiamondConnect is provided "as is" and "as available" without warranties of any kind, either express or implied.
• DiamondConnect LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
• Our maximum liability is limited to the amount paid by the user to DiamondConnect in the 12 months preceding the claim.

10. Dispute Resolution

• Any disputes arising from these Terms of Service or your use of DiamondConnect will be resolved through binding arbitration.
• These terms are governed by the laws of the State of Minnesota.
• By agreeing to these terms, you waive the right to participate in class action lawsuits against DiamondConnect LLC.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of DiamondConnect after changes are posted constitutes acceptance of the updated terms. For material changes, we will notify users via email at least 30 days before the changes take effect.
